Agreement to these terms
These Terms of Use ("Terms") govern your access to and use of the getbenik.com website and the information, demos and enquiry features on it (the "Site"), operated by benik solutions ("benik", "we", "us"). By using the Site you agree to these Terms. If you do not agree, please do not use the Site.
About benik and our products
benik is a technology company based in Lagos, Nigeria. The Site describes our products, including SchoolMind AI and our other solutions. Access to and use of any paid product is governed by that product’s own terms of service and the order or subscription you enter into for it, which prevail over these Terms in the event of a conflict for that product.
Eligibility
You must be at least 18 years old and able to form a binding contract to use the Site on behalf of yourself or the organisation you represent. By using the Site you confirm that you meet these requirements.
Acceptable use
You agree not to:
- Use the Site for any unlawful, fraudulent or harmful purpose;
- Attempt to gain unauthorised access to the Site, its servers or related systems;
- Interfere with or disrupt the integrity or performance of the Site;
- Copy, scrape, reverse engineer or exploit any part of the Site except as expressly permitted;
- Upload or transmit malware or any material that infringes the rights of others.
Intellectual property
The Site and its content, including text, graphics, logos, the benik name and marks, and software, are owned by or licensed to benik and are protected by intellectual property laws. We grant you a limited, non-exclusive, non-transferable licence to view the Site for your own informational and business use. All other rights are reserved.
Enquiries, demos and communications
Information you submit through the Site (such as a demo or contact request) is handled in line with our Privacy Policy. Any pricing, availability or product information on the Site is provided for general information, may change, and does not by itself create a binding offer.
Subscriptions and payments
Where you purchase a product subscription, billing terms (including quarterly pricing and any free trial) are set out on the relevant product page and in the product’s terms of service. Payments are processed by our third-party payment provider (Paystack); by paying you also accept that provider’s terms. Except where required by law or expressly stated, fees are non-refundable.
Third-party services
The Site may integrate or link to third-party services (for example live chat, payments and analytics). We are not responsible for third-party services, and your use of them is subject to their own terms and policies.
Disclaimers
The Site is provided "as is" and "as available". To the maximum extent permitted by law, we disclaim all warranties, express or implied, including fitness for a particular purpose and non-infringement, and we do not warrant that the Site will be uninterrupted, error-free or secure.
Limitation of liability
To the maximum extent permitted by law, benik will not be liable for any indirect, incidental, special, consequential or punitive damages, or for any loss of profits, data, or goodwill, arising from your use of the Site. Nothing in these Terms excludes liability that cannot be excluded under applicable law.
Indemnity
You agree to indemnify and hold benik harmless from any claims, losses and expenses arising out of your misuse of the Site or your breach of these Terms.
Changes and availability
We may modify, suspend or discontinue any part of the Site at any time, and we may update these Terms from time to time. Continued use of the Site after changes take effect constitutes acceptance of the updated Terms.
Governing law
These Terms are governed by the laws of the Federal Republic of Nigeria, and any dispute relating to the Site will be subject to the jurisdiction of the Nigerian courts.
